EMDR & Beyond is owned and operated by RC&T (Rocha Consulting & Training Inc.), an Iowa corporation. Throughout this document, "EMDR & Beyond," "we," "us," and "our" refer to RC&T. "You" and "your" refer to the person accessing our properties or purchasing our programs and services.
SECTION 01Definitions and Scope
These Terms and Conditions ("Terms") govern your access to and use of all EMDR & Beyond properties and your purchase of any program or service we offer.
"Sites" means emdrandbeyond.com, courses.emdrandbeyond.com, membership.emdrandbeyond.com, and any other website, subdomain, learning platform, or successor property operated by RC&T.
"Programs" means our continuing education offerings, including live in-person, live virtual, hybrid, and on-demand courses.
"Consultation Services" means individual consultation, group consultation, consultation packages, and structured consultation programs, including the Guided Comprehensive Certification Consultation program and the Consultant-in-Training Approval program.
"Content" means all materials made available through the Sites or within a Program or Consultation Service, including recordings, slides, handouts, clinical reference materials, quizzes, worksheets, written text, graphics, logos, images, audio, and video.
"Participant" means any person who registers for, purchases, or accesses a Program or Consultation Service.
Order of Precedence
Several documents govern your relationship with EMDR & Beyond. Where they conflict, they apply in this order:
- A signed consultation agreement or other written agreement between you and RC&T controls over these Terms.
- These Terms control over the Program Disclosures and over any Program-specific page, on matters of contract, payment, liability, and dispute resolution.
- The Program Disclosures control on matters of continuing education administration, accreditation, attendance, credit issuance, accessibility, conflict of interest, and grievances.
The Privacy Policy and the Program Disclosures are incorporated into these Terms by reference.
↑ Back to topSECTION 02Acceptance and Eligibility
By accessing the Sites, creating an account, or purchasing any Program or Consultation Service, you agree to be bound by these Terms. If you do not agree, do not use the Sites and do not purchase from us.
Where a checkout, registration, or enrollment page presents these Terms for your acceptance, your completion of that purchase constitutes your agreement to them.
You must be at least 18 years old. Our Programs and Consultation Services are designed for licensed mental health professionals and for graduate-level trainees in mental health disciplines who are working under appropriate supervision.
Individual Programs may carry prerequisites, which are stated on the Program page. Eligibility for EMDRIA Credits is limited to participants who have completed an EMDRIA-approved Basic EMDR Training. It is your responsibility to confirm that you meet the stated prerequisites before you purchase.

Accessing Programs requires an account on our learning platform. Accounts are personal to a single named individual and may not be shared, transferred, sold, or used by more than one person.
You agree to provide accurate, current, and complete information at registration, including your professional license type, license number, and any other credential information we request, and to keep that information up to date. We are required to keep credential information on file in order to issue continuing education documentation. Inaccurate or missing credential information may delay or prevent issuance of your certificate.
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at info@emdrandbeyond.com if you believe your account has been accessed without your authorization.
↑ Back to topSECTION 04Purchases, Pricing, and Payment
All prices are stated and charged in United States dollars. Charges appear on your statement as RC&T.
Payment is processed by our third-party payment processor. We do not store your full payment card details. You represent that you are authorized to use the payment method you provide.
We may change prices at any time. A price change does not apply retroactively to a purchase you have already completed.
Promotional codes, early registration pricing, and discounts are valid only for the offering, dates, and conditions stated at the time they are published. They may not be combined unless we state otherwise, have no cash value, and cannot be applied retroactively to a completed purchase.
Participants enrolled in the Guided Comprehensive Certification Consultation program or the Consultant-in-Training Approval program receive a 25% discount on on-demand Programs. This benefit applies for the duration of the participant's enrollment in that consultation program and ends when the program concludes.
You are responsible for any applicable taxes. If a payment is declined or reversed, we may suspend access until the amount owed is resolved.
Chargebacks
If you believe a charge is in error, contact us first at info@emdrandbeyond.com. Initiating a chargeback or payment dispute without first contacting us may result in suspension of your account and access to purchased Content while the dispute is pending. We reserve the right to contest chargebacks where our records show that access was granted, attendance was recorded, or a certificate was issued.
↑ Back to topSECTION 05Refunds and Cancellations
Refund and cancellation terms for live events and on-demand Programs are published in the Program Disclosures and are incorporated into these Terms by reference. Please review them before you purchase.
Consultation Services
Cancellation, rescheduling, missed-appointment, and lateness terms for consultation are set out in the signed consultation agreement you receive at enrollment. That agreement controls. The following terms apply in addition to it:
- Structured consultation programs. Enrollment in the Guided Comprehensive Certification Consultation program and the Consultant-in-Training Approval program is non-refundable once the program has begun.
- Consultation packages. Hours purchased as part of a package expire twelve (12) months from the date of purchase. Unused hours are forfeited at expiration and are not refundable.
- Transfers. Consultation hours, packages, and program enrollments are personal to the purchaser and may not be transferred, assigned, gifted, or resold.
SECTION 06Payment Plans and Recurring Billing
Certain consultation programs may be purchased using a payment plan. Where a payment plan is offered, the number of payments, the amount of each payment, the billing interval, and the total amount payable are disclosed before you complete your purchase, and you must affirmatively consent to the recurring charge at checkout.
Payment plan installments are charged automatically to the payment method you provide, on the stated schedule, until the plan is complete or you cancel.
Cancelling a Payment Plan
You may cancel a payment plan at any time from your account on our platform, without contacting us and without penalty for the act of cancelling. Cancellation stops future installments. It does not refund installments already charged.
If you cancel a payment plan, or if an installment fails and is not resolved within ten (10) days of our notice to you, your enrollment ends. Access to the program and to any associated Content terminates, amounts already paid are forfeited and are not refundable, and the remaining unpaid balance is waived. You may re-enroll later at the pricing in effect at that time. Hours already completed may be credited toward a later enrollment at our discretion.
Certain private or organizational engagements are invoiced directly rather than billed through the platform. Payment terms for those engagements are stated on the invoice or in a separate written agreement.
↑ Back to topSECTION 07Permitted Use of Program Content
When you purchase a Program or Consultation Service, you receive a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Content for your own professional learning and your own clinical practice. You do not acquire ownership of any Content.
No one has permission to duplicate, display, distribute, or otherwise use any Content without our prior written consent. Without limiting that statement, you may not:
- share your account credentials or allow another person to access Content through your account;
- present a Program to a group under a single registration, or host a group viewing of any Program or recording;
- record, screen-capture, photograph, or transcribe any live session or recording;
- copy, upload, post, email, print for distribution, or otherwise share handouts, slides, clinical reference materials, quizzes, or recordings;
- sell, license, rent, or redistribute Content, or incorporate Content into any training, presentation, course, or product you or a third party deliver;
- remove or alter any copyright, trademark, attribution, or proprietary notice;
- use automated tools to scrape, harvest, or extract Content, or submit Content to any artificial intelligence system for training, indexing, or reproduction.
You may use what you learn in your own clinical work. You may not teach our material as your own.
If you breach this section, we may revoke your access to the Content and terminate your account without refund, and we may pursue any other remedy available to us.

All Content is owned by RC&T or by the presenters, authors, and content suppliers who license it to us, and is protected by United States and international copyright, trademark, and other intellectual property laws. Presenter-developed materials remain the property of the presenter and are made available to you under the same limited right described in Section 7.
The EMDR & Beyond name, logo, and visual identity are our marks. You may not use them without our prior written permission.
All rights not expressly granted in these Terms are reserved.
If you believe material on the Sites infringes your copyright, contact us at info@emdrandbeyond.com with a description of the work, the location of the material, and your contact information.
↑ Back to topSECTION 09Participant Conduct
You agree to use the Sites lawfully and to conduct yourself professionally in every learning and consultation environment we host. Participant conduct and confidentiality expectations are described in the Program Disclosures, including the expectation that you protect the confidentiality of case material shared by instructors and other participants and that you avoid disclosing unnecessary identifying client information.
You may not harass, threaten, or discriminate against any participant, presenter, consultant, or staff member; transmit obscene or offensive material; disrupt a live session; misrepresent your identity, license status, or credentials; or attempt to gain unauthorized access to any part of the Sites.
We may issue a warning, remove you from a live session, suspend your account, or terminate your access and any active enrollment, without refund, for conduct that violates this section. Where a termination is not attributable to your conduct, we will refund amounts you have paid for undelivered Programs or unused consultation hours.
↑ Back to topSECTION 10Recording and Likeness
Live Programs are generally recorded. By registering for and attending a live Program, you consent to the recording and to the use of your voice and, where incidentally captured, your likeness, on the terms set out in the Use of Recordings section of the Program Disclosures, which also describes the steps you can take if you prefer not to appear in a recording. Those terms are incorporated here by reference.
You may not record any live Program yourself. See Section 7.
↑ Back to topSECTION 11Continuing Education Credit
EMDR & Beyond is an EMDRIA-approved EC Provider (#15007).
EMDR & Beyond is approved by the American Psychological Association to sponsor continuing education for psychologists. EMDR & Beyond maintains responsibility for this program and its content.
Credit is earned, not purchased. Purchasing a Program does not by itself entitle you to a certificate. The attendance, completion, quiz, and documentation requirements for each format are stated in the Program Disclosures and must be met in full. Live attendance in real time is required for credit on live Programs, and watching a recording does not substitute for it.
Board acceptance. We do not warrant that any particular state licensing board, certification body, or employer will accept a given credit toward your specific licensure or credentialing requirement. It is your responsibility to confirm that a Program satisfies your own requirements before you purchase.
Credit availability for on-demand Programs may end when a Program is retired or when its accreditation period expires. Access and retention terms are described in the Course Access section of the Program Disclosures. You are responsible for completing Programs promptly and for retaining your own copies of the certificates we issue.
↑ Back to topSECTION 12Consultation Services
EMDR & Beyond is the provider of Consultation Services and is responsible for delivering them. Consultation is delivered by EMDRIA Approved Consultants and Approved Trainers engaged by us for that purpose. Your agreement is with RC&T.
The specific terms of your consultation engagement, including hour requirements, scheduling, cancellation, rescheduling, missed appointments, and lateness, are set out in the signed consultation agreement you receive at enrollment. That agreement controls where it conflicts with these Terms.
Nature of the Relationship
Consultation is professional peer consultation. It is not clinical supervision, not psychotherapy, not employment, and not a treatment relationship. No therapist-client relationship is created between you and any consultant, and none is created between EMDR & Beyond and any of your clients.
You retain full and sole professional, clinical, ethical, and legal responsibility for your clients, your caseload, your clinical decisions, and your compliance with the requirements of your license and your jurisdiction. If you practice under supervision, your supervisor's direction governs.
Certification and Credentialing
Consultation hours delivered through our programs are structured to satisfy the consultation requirement of EMDRIA's certification and Consultant-in-Training pathways. We do not guarantee that you will obtain EMDR certification, Approved Consultant status, or any other credential. Those outcomes depend on requirements outside our control, including your caseload and session volume, your demonstrated competency, letters of reference from parties other than us, EMDRIA's own review, and EMDRIA's requirements as they exist at the time of your application. It is your responsibility to understand and track the current requirements published by EMDRIA.
Letters of reference, competency attestations, and verification of consultation hours are issued at the consultant's professional discretion, based on competency actually demonstrated during consultation. Enrollment in or payment for a program does not entitle you to a favorable attestation.
↑ Back to topSECTION 13Not Clinical Advice, Not Supervision
Our Programs, Consultation Services, Content, and Sites are provided for professional education and professional development. They are not clinical supervision, and they are not a substitute for professional mental health advice, diagnosis, or treatment for you or for any other person.
Nothing we provide creates a therapist-client relationship. Applying what you learn in your own practice is your professional judgment and your professional responsibility.
If you or someone you know needs mental health care, seek the services of a qualified licensed professional. In an emergency, call 911 or the 988 Suicide and Crisis Lifeline.

We use third-party providers to operate our business, including a learning and customer relationship platform, a payment processor, and video conferencing services. Your use of those services is also subject to their own terms.
The Sites link to third-party websites, including presenter practice sites, professional organizations, and training programs operated by other organizations. Some trainings promoted on our Sites are delivered by other organizations and are not EMDR & Beyond Programs. Registration, payment, delivery, credit issuance, and refunds for those trainings are governed by the organization delivering them.
We do not control third-party sites or services and are not responsible for their content, availability, accuracy, or practices. A link is not an endorsement.
↑ Back to topSECTION 15Technology and Availability
We do not warrant that the Sites or any Program will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue any part of the Sites or retire any Program at any time.
You are responsible for your own internet connection, hardware, software, and video conferencing setup, including keeping your video conferencing application current and confirming that your camera and audio work before a live session. Additional technology terms are described in the Program Disclosures.
We are not responsible for technology failures outside our control. If you experience a problem with our platform, contact us and we will make reasonable efforts to help resolve it.
↑ Back to topSECTION 16Disclaimer of Warranties
The sites, content, programs, and consultation services are provided "as is" and "as available," without warranty of any kind. To the fullest extent permitted by law, RC&T disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the content is complete, current, or free from error, that any clinical, professional, business, or financial outcome will result from your participation, or that you will obtain any license, certification, credential, or board acceptance of credit.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply to the fullest extent permitted by law.
↑ Back to topSECTION 17Limitation of Liability
To the fullest extent permitted by law, RC&T and its officers, employees, contractors, presenters, and consultants will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or professional or business losses, arising out of or relating to the sites, the content, any program, or any consultation service, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these terms, the sites, the content, any program, or any consultation service will not exceed the total amount you paid to RC&T in the twelve (12) months immediately preceding the event giving rise to the claim.
We are not liable for any harm to your clients or to any third party arising from your clinical practice or from your application of anything learned through a Program or Consultation Service. Responsibility for your clinical work rests with you.
These limitations do not apply to liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow the limitation of incidental or consequential damages, so parts of this section may not apply to you.

You agree to defend, indemnify, and hold harmless RC&T and its officers, employees, contractors, presenters, and consultants from and against any claim, demand, liability, damage, loss, or expense, including reasonable attorneys' fees, arising out of or relating to:
- your breach of these Terms, including Section 7;
- your clinical practice, clinical decisions, or use of anything learned through a Program or Consultation Service;
- your disclosure of client information or breach of confidentiality;
- your violation of any law or of the rights of any third party;
- content you submit, post, or transmit through the Sites or during a live session.
We will notify you of any claim subject to this section and may participate in its defense with counsel of our own choosing at our expense.
↑ Back to topSECTION 19Disputes, Arbitration, and Governing Law
These Terms are governed by the laws of the State of Iowa, without regard to its conflict of laws rules.
Step One: Informal Resolution
Before starting any formal proceeding, you agree to contact us in writing at info@emdrandbeyond.com describing the dispute and the relief you seek. We will do the same before starting a proceeding against you. Both parties agree to attempt in good faith to resolve the dispute for sixty (60) days from that notice.
Step Two: Binding Arbitration
If a dispute is not resolved informally, you and RC&T agree that it will be resolved by final and binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. You and RC&T are each waiving the right to a trial by jury.
Arbitration will proceed on an individual basis only. You and RC&T each waive any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
Arbitration will take place in Polk County, Iowa, or, at your election, by telephone, videoconference, or document submission. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court to protect intellectual property rights or to stop unauthorized use or distribution of Content.
Your Right to Opt Out
You may opt out of this arbitration and class waiver provision by sending written notice to info@emdrandbeyond.com with the subject line "Arbitration Opt-Out," including your name and the email address on your account, within thirty (30) days of the date you first accept these Terms. Opting out does not affect any other part of these Terms, and it will not affect your access to any Program or Consultation Service.
If the class waiver above is found unenforceable as to any claim or request for relief, that claim or request will be severed from arbitration and brought exclusively in the state or federal courts located in Polk County, Iowa, and you and RC&T consent to the personal jurisdiction of those courts. The remainder of this section will continue to apply.
↑ Back to topSECTION 20Changes to These Terms
We may update these Terms at any time. The revised version takes effect when it is posted, and the effective date at the top of this page will be updated. Your continued use of the Sites after a revision constitutes acceptance of it.
A change to purchase, refund, or payment terms does not apply retroactively to a Program or Consultation Service you have already purchased. The version of these Terms in effect on the date of your purchase governs that purchase.
Where a change is material, we will make reasonable efforts to notify registered account holders by email.

Entire agreement. These Terms, together with the Privacy Policy, the Program Disclosures, and any signed agreement between you and RC&T, are the entire agreement between us regarding their subject matter and supersede any prior understanding.
Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms or any rights under them. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disaster, severe weather, illness, labor disruption, utility or internet failure, platform outage, or government action. Where a live Program cannot proceed for such a reason, we will reschedule it, provide an equivalent alternative, or issue a refund.
Electronic communications. You consent to receive notices, agreements, receipts, certificates, and other communications from us electronically, and you agree that electronic delivery satisfies any legal requirement that such communications be in writing.
Survival. Sections 7, 8, 13, 16, 17, 18, 19, and 21 survive termination of your account or of these Terms.
Headings. Section headings are for convenience only and do not affect interpretation.
